1. Acceptance of Terms

By accessing and using the Boundless Wave Essence website (boundlesswaveessence.jp) and purchasing our products or services, you agree to be bound by these Terms of Service. If you do not agree with any provision, please discontinue use immediately. We reserve the right to modify these Terms at any time. Modifications become effective when posted; your continued use indicates acceptance.

2. Description of Services

Boundless Wave Essence provides artesian bottled water delivery, water filtration systems, office water cooler rental, and related hydration services throughout the Greater Tokyo Area and surrounding prefectures. We deliver products according to specified schedules and provide installation and maintenance services. All services are offered on an as-is basis in accordance with applicable laws. We reserve the right to modify service offerings, pricing, and delivery areas with reasonable notice.

3. Orders and Delivery

Orders placed through our website, phone, or email are subject to acceptance and confirmation by our sales team. Prices are quoted in Japanese yen and do not include applicable taxes unless stated otherwise. Delivery dates are estimated but not guaranteed; delays may occur due to weather, traffic, or unforeseen circumstances. We are not liable for late deliveries. Delivery is available only to addresses within our service area. Large orders may require special scheduling.

4. Subscription Plans and Cancellation

Subscription plans renew automatically on your selected schedule (weekly, bi-weekly, or monthly) unless cancelled in writing at least 14 days before the next renewal date. There are no cancellation penalties; you may cancel at any time. Pauses of up to 60 days are available upon request. Equipment rental agreements (coolers, filtration systems) require 30 days notice for termination. Upon cancellation, empty bottles must be returned within 30 days to avoid collection fees.

5. Payment and Pricing

Payment must be received before or upon delivery. Accepted methods include bank transfer, credit card, and cash on delivery for local customers. Prices are subject to change upon 14 days notice. Volume discounts and promotional pricing may apply to eligible customers. Invoicing and payment terms for corporate accounts are determined by written agreement. Overdue payments may result in service suspension or account closure.

6. Bottle and Equipment Returns

Customers are responsible for returning empty bottles within 30 days. Unreturned bottles are charged at ¥500 per bottle. Coolers and filtration equipment remain Company property. Damage to equipment beyond normal wear resulting from customer negligence is chargeable at repair or replacement cost. Equipment must be returned in working condition upon contract termination.

7. Product Quality and Warranty

All water products meet or exceed Japanese Ministry of Health drinking water standards. We warrant that products are delivered fresh and uncontaminated. If product quality is defective upon delivery, notify us within 24 hours with proof. Coolers and filtration equipment are warranted against defects for 12 months from installation. Warranty does not cover misuse, improper installation, or normal wear. In-warranty repairs or replacements are provided at no charge.

8. Liability Limitations

To the maximum extent permitted by law, Company is not liable for indirect, incidental, consequential, or punitive damages. Our total liability for any claim does not exceed the amount paid for the specific product or service causing the claim. We are not liable for service interruptions due to force majeure, third-party actions, or circumstances beyond our control. Some jurisdictions do not allow limitation of liability; local law may apply.

9. User Conduct

You agree not to use our website or services for illegal, harmful, or abusive purposes. Prohibited conduct includes transmitting malware, hacking, spamming, harassing others, violating intellectual property rights, or reselling our products without authorization. We reserve the right to suspend or terminate service for violations. Your account may be terminated without refund if these terms are breached.

10. Intellectual Property

All content on our website, including logos, images, text, and designs, is owned by or licensed to Boundless Wave Essence and is protected by copyright and trademark law. Reproduction, distribution, or modification without written permission is prohibited. You may view and download content for personal, non-commercial use only.

11. Third-Party Links and Services

Our website may contain links to third-party websites or services not controlled by us. We are not responsible for their content, privacy practices, or operations. Use of external sites is at your own risk. We do not endorse third-party products or services.

12. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy. By using our services, you consent to such collection and processing. Information provided is held in confidence and used only for service delivery and improvement.

13. Indemnification

You agree to indemnify and hold harmless Boundless Wave Essence, its owners, employees, and agents from any claims, damages, costs, or liabilities arising from your violation of these Terms, misuse of our services, or infringement of third-party rights.

14. Dispute Resolution

These Terms are governed by the laws of Japan. Any disputes shall be resolved through mutual negotiation or, if necessary, through the Tokyo District Court. Informal resolution is preferred; if litigation is required, you agree to submit to Japanese jurisdiction.

15. Entire Agreement

These Terms constitute the entire agreement between you and Boundless Wave Essence regarding use of our website and services, superseding any prior agreements or communications. If any provision is found invalid, the remaining provisions remain in effect.
